Per
my eMail to Lee Osman, August 23, 2005, which I
copied
to you, I confirmed being in receipt of your
letter
dated August 2, 2005. Your letter
impressed me
by
starting with, “...an amicable resolution suitable
to
both parties...” and ending with, “...discuss a
more
amicable resolution.” Your letter
convinced me
that
after five months of reviewing this matter, your
firm
is prepared to assist StairMaster in ending a 13
year
business dispute.
Since
Seed IP is the firm that acquired the patent for
me,
I forwarded your letter to Managing Director and
CEO,
Bill Ferron, for his review and advice.
Mr.
Ferron
advised me that for Seed IP to be involved in
the
amicable resolution, it would be necessary to get
a
waiver of conflict from Nautilus, Inc.
However,
five
weeks after making the inquiry, Mr. Ferron
advised
me, that you notified him, Nautilus is not
willing
to execute a waiver.
Mr.
Tamkin, to reach an amicable resolution, it is
imperative
to have an amicable start. The waiver
was
the
point of contention with the old StairMaster;
precisely
the reason we are at this impasse today.
Trying
to reach an amicable resolution without a
waiver,
Nautilus maintains the same unfair advantage,
by
denying me representation of the firm responsible
for
the patent.
As
I mentioned, your letter impressed me with its
serious
tone of resolve. However it contains numerous
claims
and assertions about the patent. Who
better to
address
those issues, than Seed IP? Seed IP is
the
firm
that has consulted me since the product’s
inception. Who better to aid you in an amicable
resolution?
Based
on the “unique circumstances” of this matter, I
am
convinced it is in the best interest of all parties
(individually
and corporately) to execute the waiver,
conduct
the conference call and bring things to a
close
as expeditiously as possible.
