I hope things have been
well with you. As you may recall, I handled the StairMaster
patent portfolio prior to its purchase out of bankruptcy by your client Nautilus
and the subsequent transfer of all patent files to you. I assume Nautilus
still owns the StairMaster business and you represent
the company in patent matters.
I have been asked by Dave
Allen, who was a client of my former firm Seed and Berry LLP, to introduce him
to you, and provide you with his design patent Des.400,941 (copy
attached). For reasons unimportant here, I do not represent Dave, but
only provide this introduction as a courtesy and to facilitate what will
hopefully be an amicable resolution of the matter described below.
Dave had for some time
attempted to interest StairMaster in his "Rack
for an Exercise Apparatus" invention shown in his patent, but without much
success. You can get the full story as described by Dave by going to

various links. Dave and I have been discussing this matter off and on
over the past six weeks. While I do not represent Dave, I suggested he
discuss the matter with you since I knew you took over the StairMaster
patent matters for your client Nautilus, and would be a good person to
contact. Dave would like to finally get a favorable resolution of this
matter. I assume Nautilus is still selling a rack such as
the one shown in Dave's patent.
After you review the
history of the matter, I urge you to communicate directly with Dave. Of
course, Dave may eventually elect to get an attorney involved on his behalf to
bring this matter to closure if he cannot work out a satisfactory resolution on
his own. Again, since I do not represent Dave and Dave wishes to discuss
the matter personally with you, please direct all your communications to
