In answer to your question, no, I do not believe you

represent StairMaster or Nautilus.  However, with all

due respect, I find it hard to believe that you have

“NO connection with Nautilus” whatsoever.  StairMaster

was a major client of Seed & Berry while you were a

Partner.  Therefore, while you may not have “a

contact” at Nautilus, I do believe you have “a

connection” for the purpose I’ve previously stated.

 

Yes, I know StairMaster went bankrupt and was

purchased by Nautilus.  However, that does not negate

the fact, that while the company was StairMaster and a

client of Seed & Berry, the “patent

infringement/conflict of interest” was mismanaged. 

 

I appreciate the contacts you provided, however as I

mentioned in my last eMail, this is a “connect the

dots” intellectual property matter and they connect to

you.  After seven years, it is not reasonable, nor

logical for me to start cold calling attorneys and be

taken seriously.  I’ve already been down that road

which is why I’m insisting that you connect the final

dot.   

 

I also appreciate your modesty by describing yourself

as “just another attorney.”  However, as a Partner of

one of the most recognized firms in the country, I

respectfully disagree.  Your decision directly

affected the outcome of my situation.  And therefore,

I do not “need independent counsel without any prior

connection to this matter” and believe it is in your

best interest and mine, to facilitate a resolution.

No other “attorney would have the same impact;” you

initially impacted this matter. And therefore, like it

or not, that puts you in a “special position” to

correct a situation I’ve patiently waited to have

corrected.

 

Lastly, it’s been awhile since I’ve seen George Fox as

well.  I agree that it was “a terrible tragedy for a

man so young.”  Mr. Fox was one of the sharpest men

I’ve ever met.  As I mentioned, I deliberately found

him to avoid winding up in a situation like I’ve wound

up in.  George Fox would have done the right thing and

now I’m trusting you will.
