Dave, first a question.  You say "You're the one with the connection

with Nautilus, Inc. to resolve this matter expeditiously and quietly,

once and for all. And you're the one with as much to gain as I have to

lose."  Do you believe I represent StairMaster or Nautilus, or have

some special connection with them?  I do not.  I have NO connection with

Nautilus, and never did have one.

 

As you know, StairMaster went bankrupt several years ago before I left

Seed & Berry.  The assets were purchased by Nautilus, a completely

unrelated company with its own patent and trademark attorneys.  All

StairMaster patent and trademark properties were take over by and I

believe are still be handled by the Nautilus attorneys.  The lead

attorney used by Nautilus for patent matters is Lee Osman

(303-629-3434) in the Denver office of the law firm of Dorsey & Whitney LLP

(370 Seventeenth Street, Suite 4700, Denver, Colorado 80202-5647).  I have

no contact with Mr. Osman and have never met him in person.  From my

research it appears a person at Nautilus you may wish to contact is

Holden J. Bank, the Vice President, Corporate Counsel and Assistant

Secretary, at 1886 Prairie Way, Louisville, Colorado 80027.  I do not

know his telephone number. 

 

Please understand that I have no connection with Nautilus and cannot do

any more for you than any other patent attorney in seeking a resolution

of your infringement matter.  With respect to the resolution you seek,

I am just another patent attorney and have no connection with Nautilus

that could give you some advantage.  I have no way of resolving this

matter "expeditiously and quietly" as your email indicated might be

possible, at least not way that cannot be used by any other patent

attorney you hire.  As would any other attorney, I would have to write

a letter to Mr. Osman, the outside attorney at Dorsey & Whitney, and/or a

letter directly to Mr. Bank at Nautilus.  A letter from another

attorney would have the same impact as one written by me.  I am in not special

position and have no connections that will give you any more help than

you can get from any other patent attorney. 

 

And again, while I wish you the best of luck, I really feel it is not

In your best interest or mine to have me involved.  You really need

independent counsel without any prior connection to this matter, Seed &

Berry or George Fox, and an attorney who desires to handle your matter

and has the time to do so.

 

By the way, while I have not seen George Fox for some months, last time

George visited he was doing well.  However, the unfortunately stroke

has left him impaired.  A terrible tragedy for a man so young.
