Dave,
I am responding to your March 16 email to Bill Ferron. It is my understanding that you
originally contacted Mr. Ferron in March 2005 and
asked whether Seed Intellectual Property Law Group PLLC (Seed IP) could assist
you in negotiations against Stair Master. Mr. Ferron
advised you that assisting you would likely require a conflict of interest
waiver because Seed IP did work for Stair Master. Mr. Ferron
agreed, per your request, to see if Stair Master would waive any conflict of
interest issues and allow someone at Seed IP to assist you. They have
declined to do so. Given their objection, we
are bound by the Washington State Bar Association's Rules of Professional
Conduct which preclude us from representing you in this matter. This is
also why Bill asked that he be dropped from your ongoing email correspondence
with Stair Master's counsel.
We would be happy to provide you the names of other counsel who
may be able to represent you. Please let me know if you would like a list
of other counsel.
